Notice of Public Hearing
The Town of Rhinebeck Planning Board shall conduct a combined Public Hearing on Monday, June 20, 2011, at the Rhinebeck Town Hall, 80 East Market Street, at 6:35 p.m. on the below Applications by Rhinebeck Gardens Group, LLC, in the matter of the proposed development of Phase III of The Gardens at Rhinebeck.
o Application for Site Plan Review and Approval under Town Code Chapter 125, Zoning Law, Article III, Section 125-20, District Schedule of Use Regulations, and Article VII, Site Plan Review and Approval.
o Application for Special Use Permit under Town Code Chapter 125, Zoning Law, Article VI, Section 125-40, Development near Streams, Rivers, Wetlands and Other Water Bodies.
o Application for Special Use Permit under Town Code Chapter 125, Zoning Law, Article III, Section 125-20, Schedule of Use Regulations, and Article VI, Section 125-68NN, for Major Excavation.
o Application for Wetland Permit under Town Code Chapter 120, Wetlands Law.
Phase III is depicted on a 15-sheet set of Site Plan drawings prepared by the Chazen Companies and dated February 14, 2011, and consists of 92 residential condominium-type dwelling units and associated site improvements on 24.45-acre TMP 6170-04-010475 located to the south of Astor Drive and west of Garden Way. While the parcel is today zoned Rural Agricultural (RA) District the proposed development would be taking place pursuant to a Special Use Permit issued by the ZBA on February 13, 1987, and which has been determined by the Zoning Administrator to remain in effect.
The Proposed Action is a Type I Action under SEQRA with the Planning Board serving as Lead Agency for coordinated environmental quality review.
All those having an interest in the above Applications will be given an opportunity to be heard at the combined Public Hearing and may also submit comments in writing to Joan Winne, Planning Board Clerk, not later than 12:00 noon on June 20, 2011. The Applications may be examined prior to the Public Hearing at the Town Hall during normal business hours.
