ZONING BOARD OF APPEALS

MEETING MINUTES OF JULY 15, 2009

 

 

PRESENT: David Baldauf, Chairman                         ABSENT:

I.       CALL TO ORDER

          The meeting was called to order at 7:30 p.m.

 

II.      APPROVAL OF MINUTES

          Meeting minutes of June 17, 2009, were reviewed and approved. 

          Motioned by Michael and seconded by Jeff, the August 5, 2009, meeting was cancelled.

 

III.     NEW BUSINESS

          Sherrod, Barry & Kelly - Case #773 - Area variance application for rear setback reduction from 35 feet to 30 feet for property located at 323 Ackert Hook Road, Rhinebeck, New York.  Applicant's authorized representative, John Sullivan was present and reviewed the application with the Board.  Mr. and Mrs. Sherrod wish to build an addition to their existing sun porch.  The property sits on 2.18 acres.  Motioned by Jeff and seconded by Pierce, the application was accepted.  A Public Hearing was set for August 19, 2009, at 7:35 p.m.

 

          Gasparini, Anthony & Denise - Case #774 - Area variance application for side setback reduction from 35 feet to 30 feet for property located at 102 Old Albany Post Road, Rhinebeck, New York.  Mr. Gasparini was present and reviewed the application with the Board.  Mr. Gasparini will be building a 16' x 34' 4" addition to his single family dwelling.  He is requesting 32' 5" side setback.  The home is 35' from the lot line.  Motioned by Pierce and seconded by David, the application was accepted.  A Public Hearing was set for August 19, 2009, at 7:45 p.m.

 

 IV.    PUBLIC HEARINGS

          Sie, Susan - Case #768 (Continuation) - the Public Hearing was opened at 7:52.  David stated the Board is awaiting input from the Planning Board, as Lead Agency, regarding any recommendations and comments received.  The Board will review the complete Planning Board file on this case.  Neighboring property owners, Mike Amsden and Greg Sokaris expressed concern about the demolition of existing building and design of replacement structures.  Mr. Amsden and Sokaris are respectful that this process is being taken to determine approval for demolition of an historic structure.  The Public Hearing was adjourned at 8:05 p.m. until August 19, 2009, at 7:50 p.m.

 

      VI.       ADJOURNMENT

                  The meeting was adjourned 8:15 p.m.
